Terms and Conditions.

Our sacred offering contains a natural psychoactive compound known for its profound spiritual benefits and significant effects on the body and mind. The Divine Science Society utilizes this sacred offering for religious purposes, not as a form of medical treatment or mental health therapy.

While the spiritual benefits can be profound, there are important contraindications to consider before partaking in the sacred offering. It should always be consumed in a safe and controlled setting. Some contraindications to be aware of include the following: Mental Health Conditions, personal or family history of psychosis, pregnant or breastfeeding, individuals on medications, high blood pressure or heart conditions should avoid taking and/or consult with a physician before taking our sacred offering.

I, by participating in the activities associated with the Divine Science Society, understand that during my participation in said activities I may be exposed to a variety of hazards and risks, foreseen or unforeseen, which are inherent in these activities. These inherent risks include, but are not limited to, the dangers of serious personal injury, sickness from ingested plants or fungi, property damage, and death (“Injuries and Damages”). I know that Injuries and Damages can occur by natural causes or activities of other persons, Divine Science Society members, Divine Science Society leaders, assistants or third parties, either as a result of negligence or because of other reasons. I understand that risks of such Injuries and Damages are involved in Divine Science Society activities and the use of our spiritual sacred offering, and I appreciate that I may have to exercise extra care for my own person and for others around me in the face of such hazards. In consideration for my acceptance as a participant in Divine Science Society activities, I confirm my understanding that:

1. This Agreement is intended to be as broad and inclusive as is permitted by law. If any provision or any part of any provision of this Agreement is held to be invalid or legally unenforceable for any reason, the remainder of this Agreement shall not be affected thereby and shall remain valid and fully enforceable.
2. The consumption of some plant medicines carry with it some inherent risks. Reactions to plant medicine vary, and I acknowledge that the Divine Science Society, its owners, employees, agents, and leaders, will not be held liable in the event that a negative reaction occurs. Further, I agree that the Divine Science Society, its owners, employees, agents, and leaders, are not liable for any future reactions from ingesting our sacred offerings.
3. I am choosing to participate in the ceremonies and consume the sacred offering of my own free will. I confirm that I can choose whether or not to participate in a free and informed manner.
4. I am of sound mind and body to sign this release, and I am over the age of 18 years old.
5. I have not been advised not to consume plant medicine by a medical professional.

Despite the foregoing risks and all other risks, and TO THE FULLEST EXTENT ALLOWED BY LAW, I AGREE TO EXPRESSLY ASSUME ALL RISKS OF INJURY OR DEATH which might be associated with or arise out of my participation in any Divine Science Society activities. In consideration for being permitted to participate in these activities, I AGREE TO RELEASE AND DISCHARGE FROM ANY LEGAL LIABILITY AND AGREE NEVER TO SUE the Divine Science Society, its directors, officers, employees, agents, and leaders, and all of their successors, heirs, assigns, directors, officers, partners, investors, shareholders, members, agents, any land owners for which events take place, and employees, for injury or death resulting from my participation, regardless of the cause. I waive my insurers’ right to make a claim against the Divine Science Society based on payments by insurers to me or on my behalf for any reason, meaning my insurers have no right of subrogation against the Divine Science Society.

I hereby agree to indemnify, defend and hold harmless the Divine Science Society from any and all claims, actions, damages, awards, or losses, including legal fees, that it may incur or sustain as a result of, or in connection to, my participation in ceremony and consumption of the sacred offering.

I understand that this is a continuing release of liability, and will apply whenever I participate in the activities associated with the Divine Science Society. I understand that this release will prevent me or my heirs from filing suit or making any claim for damages in the event of injury or death from my participation.

This release shall be governed by the laws of California and I hereby consent to the exclusive jurisdiction of such courts.

With a full understanding of this agreement, I nevertheless enter into it freely and voluntarily and agree that it is binding upon me, my heirs, assigns, my legal representatives, and the users of any sacred offering originating from the Divine Science Society.

I AGREE to abide by all applicable local, state and federal laws, as applicable.

WITH ALL OF THE ABOVE FULLY UNDERSTOOD, I enter into this agreement freely and voluntarily.

I have read this document in its entirety and I freely and voluntarily assume all risks of such Injuries and Damages and notwithstanding such risks, I agree to participate in Divine Science Society activities.

By applying for membership with the Divine Science Society, I agree and consent to the foregoing Agreement.

I acknowledge that my use or consumption of any product or sacred offering supplied by Divine Science Society is voluntary and undertaken at my own risk. To the fullest extent permitted by applicable law, I knowingly and voluntarily assume the inherent risks associated with such use or consumption, including adverse physical or psychological reactions, allergic reactions, interactions with medications or other substances, impairment, serious injury, and death. Individual responses may vary, and prior use without adverse effects does not establish that future use will be safe.

I am responsible for reviewing and complying with all product labels, instructions, warnings, and restrictions, and for obtaining advice from a qualified healthcare professional regarding my individual circumstances, including any medical conditions, medications, or other potential contraindications. Information provided by Divine Science Society does not constitute medical advice and is not a substitute for professional diagnosis, treatment, or individualized medical guidance. No particular effect, benefit, or outcome is guaranteed.

To the fullest extent permitted by applicable law, I agree that Divine Science Society and its directors, officers, employees, agents, and leaders shall not be liable for injury, loss, or damage arising from the inherent risks of my voluntary use or consumption of its products or sacred offerings, or from my misuse of them or failure to follow applicable instructions and warnings. This provision applies whether such use occurs during a Divine Science Society activity or independently of any ceremony or supervised setting.

Notwithstanding anything to the contrary in these Terms and Conditions, no provision excludes or limits liability for fraud, willful misconduct, gross negligence, or any other act, omission, or liability that cannot lawfully be excluded or limited. Nothing in these Terms and Conditions waives any non-waivable statutory right or remedy, including applicable consumer protection or product liability rights. This limitation controls in the event of any conflict with another release, waiver, indemnity, or disclaimer in these Terms and Conditions.

This document is intended as a formal Declaration of Religious Belief. I, the undersigned, do hereby acknowledge that our sacred offerings are an essential and inseparable part of my religious practice.

I do therefore declare that my consumption and cultivation of the sacred offering to be a strictly religious practice afforded First Amendment protection under the Constitution of the United States of America.
